PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. YOUR PARTICIPATION IN RCL CRUISES’ SUMMER OF CONSULTANT REWARDS INCENTIVE IS SUBJECT TO ALL OF THESE TERMS AND CONDITIONS. BY ENROLLING IN THE PROMOTION, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.   

ELIGIBILITY

To enrol in RCL Cruises’ Summer of Consultant Rewards incentive, an individual must satisfy each of the following requirements: 

The enrolee must be an individual. RCL Cruises’ Summer of Consultant Rewards incentive is not open to corporations, partnerships or other entities.

The enrolee must be a registered retail travel consultant aged 18 years + located in Australia or New Zealand.

If you are self-employed, you must be registered as a travel agency with RCL Cruises and in good standing.

If you work for a travel agency, that travel agency must be fully registered on the RCL Cruises Agency Database and in good standing with RCL Cruises Ltd.  

Where required by applicable law, the enrolee must possess a valid license as a travel agent and be in good standing.

The enrolee’s participation in the Summer of Consultant Rewards incentive must not violate the enrolee’s employer/headquarter agency policies. Please check your employer/headquarter agency policies before enrolling. If enrolment would violate an employer’s policies or applicable law or if enrolment would be restricted by applicable law, RCL Cruises may cancel that individual’s enrolment, his or her participation in the Promotion without notice and without liability to RCL Cruises of any kind and any points or other benefits otherwise provided by the promotion shall be forfeited.  

An individual may only have one valid registration in the Summer of Consultant Rewards incentive. In the event an individual has multiple account numbers with the promotion, RCL Cruises may cancel all or, at its discretion, all but one of those account numbers. In addition, RCL Cruises may cancel that individual’s enrolment and his or her participation in the Promotion without notice and without liability to RCL Cruises of any kind and any points or other benefits otherwise provided by the Promotion shall be forfeited.  

ENROLMENT 

Eligible retail Travel Consultants may enrol in the Promotion in any of the following ways:   

Register as an individual participant in the Summer of Consultant Rewards incentive by logging into www.clubroyal.com.au and completing the online Promotion registration form.

Finally, you must accept the promotion’s Terms and Conditions in the manner provided at www.clubroyal.com.au. Applicants agree to be bound by all the promotion Terms and Conditions as the same may be modified from time to time with or without notice and failure to comply with these Terms and Conditions, including any abuse of the reward earning criteria or any misrepresentation of information to the Promotion Administrator, may result in termination of your membership in the Promotion.  

If at the time of your initial registration in the Promotion, you were eligible for enrolment but subsequently you are no longer eligible, for example you no longer work for an Approved Travel Agency or your employer’s policies changed since registration in a way that prohibits or restricts your participation in the promotion or if you elect to terminate your participation in the promotion, then RCL Cruises may without liability to the Participant: 

Cancel any Pending Points in your Summer of Consultant Rewards Incentive account;

Permit the Participant to utilize any points in their Redeemable account balance up to that time in accordance with the terms of the Promotion for a period to be determined by RCL Cruises but which shall not exceed 30 days; provided, however, that if your employer/headquarter location is no longer an Approved Travel Agency then you will have ten (10) days in which to redeem your Redeemable Points after which such Redeemable Points may be cancelled without further liability to RCL Cruises.    

The promotion administrator is Motivforce Marketing & Incentives Pty Ltd, Level 14, 309 Kent Street, Sydney NSW 2000, Australia (hereinafter “Promotion Administrator“).

EARNING POINTS 

 

NEW YEAR BONUS PROMOTION: 
RCL Cruises will award Double Points to any fully-deposited Royal Caribbean, Celebrity Cruises and Azamara Club Cruises bookings made between 1 and 16 January 2018. The standard terms and conditions of the Summer of Consultant Rewards Programme will apply to this promotion in regards to Qualifying Bookings, Claiming Points, Reward Rates and Redemption.

RCL Cruises’ Summer of Consultant Rewards incentive is a retail travel consultant rewards promotion that has been specifically designed to reward travel agents for bookings made on Royal Caribbean, Celebrity Cruises and Azamara Club Cruises.  The Promotion enables Participants to earn points for every Royal Caribbean, Celebrity Cruises and Azamara Club Cruises booking they make, which can then be spent on rewards subject to these Terms and Conditions and any special rules regarding a particular redemption option.  

Participants can earn Points on “Qualifying Bookings”. A “Qualifying Booking” is a new fully-deposited booking for either a Royal Caribbean, Celebrity Cruises or Azamara Club Cruises made by the Participant.  When a Qualifying Booking is made, you must “Claim” the Qualifying Booking. Requests made after the expiration of a thirty (30) day period may not be honoured. To “Claim” the booking, you must provide all required information at www.clubroyal.com.au. A Qualifying Booking cannot be transferred. In addition, any existing booking as of the Launch Date cannot be claimed.

In addition, Royal Caribbean, Celebrity Cruises and Azamara Club Cruises will award one 2019 cruise prize per brand to the Top Seller consultant who achieves the highest number of new fully-deposited bookings during the Summer of Consultant Rewards incentive period. The cruise prize is valid for the winner and one companion only. Winners will be announced at the end of the incentive period. The winner and their travelling companion are responsible for all other expenses including but not limited to: domestic and international air travel to and from cruise departure port, any other travel or onboard costs/expenditure, pre or post cruise accommodation, spending money, meals (other than those specified), drinks (other than those specified), mini-bar, incidentals, laundry, room service, phone calls, gratuities, optional activities and excursions, freight, excess baggage, ground transport, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, service charges, passports, visas, travel insurance, and all transfers, including travel costs to and from their closest capital city airport if the winner is from a regional area. The winner is responsible for ensuring that they and their travelling companion are fit to travel and have received appropriate immunisations and/or health checks prior to taking the prize.

It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas which meet the requirements of immigration and other government authorities at the destinations. Any fines, penalties, payments of expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller. 

From time to time, RCL Cruises may run promotions allowing Participants to earn bonus points. The terms and conditions of the promotion shall apply to the applicable promotion. Active promotions will be available to view once logged in at www.clubroyal.com.au 

Points will not be awarded for: (a) bookings made on any charter or incentive group sailing; (b) travel agency rate bookings; (c) any Free Of Charge bookings; (d) and any Casino Future Cruise vouchers.   

We reserve the right to pursue available legal remedies for violations of the Promotion and these Terms and Conditions. 

You may check your Account Balance at any time by visiting www.clubroyal.com.au and logging into your account. A Qualifying Booking will not result in the crediting of any Redeemable Points to your account. The classification of a Qualified Booking is a booking through RCL Cruises satisfying the following criteria: 

REDEMPTION 

All rewards are subject to availability and the promotion Administrator and RCL Cruises do not guarantee or warrant in any way that the rewards offered under the Promotion will be, in the event that an advertised reward is not available, a suitable substitute of equivalent function or value will be made.

Participants can redeem their earned Redeemable Points for an equivalent monetary value that will be displayed to Participants based on their available Redeemable Points balance.

Rewards are not transferable.

Participant will bear full responsibility for all taxes owed on any Rewards they receive.

Any cruise utilized by a Participant under this Promotion is bound by the Terms and Conditions of RCL Cruises that will be enforced from time to time.

The Promotion Administrator’s decision on reward allocation is final and no correspondence will be entered In relation to the interpretation of the Terms and Conditions and any phrases in this promotion, the decision of Promotion Administrator is final.

In order for the associated points to be awarded to a Participants Account Balances, bookings must be claimed via the Rewards Website within 30 days from the date that they were uploaded. After 30 days, the bookings data will be removed and no longer able to be claimed.   

Promotion Definitions

The following definitions apply to the promotion: 

Account Balance – the points associated with a Participant as recorded on the Summer of Consultant Rewards website as a Redeemable Points Balance or a Pending Points Balance. 

Approved Travel Agency – Australia and New Zealand based travel agencies authorised by RCL Cruises to promote and sell Royal Caribbean, Celebrity Cruises and Azamara Club Cruises in one of the foregoing locations and who are in good standing with RCL Cruises.  

Participant – A Participant that has successfully registered with the Promotion in accordance with these Terms and Conditions.

Redeemable Points Balance – the total number of points that have been earned by a Participant and which may be converted by a Participant to rewards. 

Rewards Website – means www.clubroyal.com.au

 

General promotion Terms and Conditions

We do not make any representations or warranties whatsoever with respect to the Promotion or any award, reward or benefit you may obtain or have available to you in connection with the Promotion. We are not responsible for errors including, without limitation, lost, late, damaged, misdirected, illegible, incorrect or incomplete communications, transmissions, or technical failures in connection with enrolments, rental transactions, inquiries, or any other type of communication and without limiting the generality of the foregoing, even if it is determined our systems or procedures or any other act or omission on our part caused the error.  

Also, Participant agrees not to interfere or attempt to interfere with the operation of the Promotion in any manner or attempt to gain unauthorised access to the information we hold about your or anyone else’s participation in the promotion. You agree that you will not use the promotion in any manner that could damage, disable, overburden, or impair the Promotion or interfere with any other Travel Consultant’s participation in the Promotion. Disclosure of your information will be in accordance with our privacy policy. 

We reserve the right to change, amend, modify or suspend the Promotion, in whole or in part, at any time with or without notice. Further, we reserve the right to terminate the Promotion at any time without individual notice to you. Upon the effective date of termination of the promotion, the following rules shall apply:

Effective as of the effective date of the termination of the Promotion, any bookings you make for a Royal Caribbean, Celebrity Cruises, or Azamara Club Cruises will no longer be eligible to potentially earn Redeemable Points;

Any Redeemable Points you have will by 30th April 2019.

Any questions, interpretations or disputes regarding the meaning or interpretation of these Terms & Conditions – will remain at the sole discretion of RCL. RCL decisions for all purposes will be binding and final.  

RCL Cruises decision on all matters pertaining to the Promotion is final and binding.

You agree to indemnify, release and hold harmless RCL Cruises, its parents, affiliates, subsidiaries, licensees and their respective shareholders, officers, directors, employees, agents, successors and assigns, from and against any claim, demand, threat or action that may arise out of or in connection with the Promotion, your enrolment, participation and your acceptance or use of any award, reward or benefit you may obtain or have available to you in connection with our Promotion.

It is your sole responsibility to ensure the accuracy and completeness of the information you provide and we obtain (or fail to obtain) in connection with your participation in this Promotion. It is the responsibility of the Participant to advise the promotion Administrator of any change in agency phone number, change in address, change of contact details, or change of employer by sending their details in writing to the Summer of Consultant Rewards Incentive Helpdesk via the Contact Us page on www.clubroyal.com.au

It is the Participant’s responsibility to keep passwords and username details secret. RCL Cruises shall accept no responsibility for any loss suffered by Participants where such loss is attributed to a failure by Participants to maintain account security.

Individual points awarded and/or the activities of Participants may be subject to random audit procedures at the discretion of the promotion Administrator during or subsequent to the completion of the Rewards promotion. In the event of any suspected irregularities, misuse or fraud, RCL Cruises shall be entitled and, where verified, terminate Participant’s membership of this Rewards promotion without any liability whatsoever.

No pooling of points will be accepted and any Participants who are found to be pooling points will have all Pending and Redeemable Points removed from their Account Balance and dissolved and their participation in the promotion will be immediately terminated.

Booking data for the Participant’s agency for the previous week of sales typically will be uploaded to the Promotions website by 10:00 am AEDT each Tuesday.

It is the Participant’s responsibility to log on to the Promotion Website to claim the bookings they have individually made. Any point discrepancies need to be directed to the Promotions Help Desk via the Contact Us page on www.clubroyal.com.au with the detail and nature of the discrepancy. Please allow 48 hours for the Help Desk to respond to a query.

Points earned by a Participant are individually owned by them but are non-transferable. Earned points are points that have a ‘Redeemable’ status. Should a Participant change employers but remain within an Approved Travel Agency, they will retain all their currently earned Redeemable Points within their Account Balance, but will forfeit all their Pending Points. Any sales that have not been claimed by the Participant by the last date of employment with their original employer may no longer be claimed by the Participant.

 

CLASS ACTION RELIEF WAIVER. YOU HEREBY AGREE THAT YOU MAY BRING CLAIMS AGAINST RCL CRUISES LTD ONLY IN YOUR INDIVIDUAL CAPACITY. EVEN IF THE APPLICABLE LAW PROVIDES OTHERWISE, PARTICIPANT AGREES THAT ANY LAWSUIT AGAINST RCL CRUISES LTD, OR ITS AFFILIATES, SUBSIDIARIES OR PARENT COMPANIES WHATSOEVER SHALL BE LITIGATED BY YOU INDIVIDUALLY AND NOT AS A MEMBER OF ANY CLASS OR AS PART OF A CLASS OR REPRESENTATIVE ACTION, AND YOU EXPRESSLY AGREES TO WAIVE ANY LAW ENTITLING YOU TO PARTICIPATE IN A CLASS ACTION.

Regardless of the form of action or the basis of the claim, under no circumstances and in no event shall we be liable for: (a) any indirect, incidental, consequential, special, exemplary or punitive damages of any kind in connection with the promotion and/or these Terms and Conditions; and/or (b) for any direct, compensatory or other damages in an amount in the aggregate, in excess of actual provable damages or $300, whichever shall be less.

The promotion is void where prohibited by federal, state or local law. These promotion Terms and Conditions set forth all the terms of the promotion in addition to, and supplement, the promotion redemption rules that govern the redemption of points, and any other redemption rules provided by us or our agents. We have no other obligation with respect to the promotion beyond those described in these Terms and Conditions.

Points earned (i.e. Redeemable Points) are not the property of the Participant and are not transferable, have no cash value, and cannot be used as payment of any obligation to us or our affiliates, except to the extent specifically enumerated in the Redemption Rules. Any points shall be permanently forfeited if your Account has been closed, or upon the Participant’s death. If there is any abuse of the promotion, failure to follow promotion terms, or any misrepresentation by you, all unredeemed points shall be forfeited and no additional points shall accumulate. There is no maximum number of points that you can accumulate in the promotion. Pending Points have not been earned are not property, are not transferable, have no cash value and cannot be used as payment of any obligation to us or our affiliates. 

Termination

Failure of a Participant to comply with these Terms and Conditions may result in the termination of a Participant’s involvement in the All decisions by RCL CRUISES LTD are final.

Any tampering with the Promotions website such as modifying, adapting, translating or reverse engineering any portion of the website will result in instant dismissal from the Rewards promotion and financial penalties may be incurred by the

A Participant may terminate their participation in the promotion by providing notice in writing to the Promotion Administrator via the Contact Us page on www.clubroyal.com.au

Data Usage  

You agree by participating in the Rewards promotion that RCL CRUISES LTD and the Promotion Administrator shall be permitted to share personal information with each other relating to Participants for the purpose of administering the promotion.

You further agree that the Promotion Administrator shall be permitted to share your personal details with third party suppliers of goods and services for the purpose of arranging delivery of rewards.

You also agree that the Promotion Administrator shall further be permitted to use unidentifiable aggregate data for the purpose of obtaining statistical data relating to all aspects of the Rewards promotion and shall be permitted to share such information with RCL CRUISES LTD.

You further agree that by registering for this Rewards promotion that we may contact you from time to time by email to update you on rewards, points and promotions. If participants of the rewards promotion need to update their email preferences, please contact the helpdesk via the Contact Us form on www.clubroyal.com.au
